Terms of Service
Overview
Welcome to Kilt District. The terms "we", "us" and "our" refer to Kilt District.
Kilt District operates this website and online store and provides the products, information, content and services available through it.
Our online store is powered by Shopify.
These Terms of Service, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, explain the terms that apply when you browse our website or purchase products from us.
Please read these Terms carefully before placing an order.
Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be limited or excluded.

2. Using Our Website
You may use our website only for lawful purposes.
You must not misuse our website, attempt to gain unauthorised access to it, introduce malicious software, interfere with its operation or use it in a way that infringes the rights of Kilt District or any third party.
You are responsible for ensuring that information you provide when placing an order is complete and accurate.
If you create a customer account, you are responsible for keeping your account and login information secure.
3. Our Products
We make reasonable efforts to describe and display our products accurately.
Our products include traditional tartan kilts, utility kilts, hybrid kilts, leather kilts, modern kilts and other kilt styles.
Product colours may appear differently depending on your device, screen settings, photography and lighting.
Tartan positioning, pleating, stitching, grain, texture and other details may vary between individual products, particularly on handmade or individually produced items.
Minor variations that are normal characteristics of the material or manufacturing process are not necessarily defects.
Product descriptions, specifications, prices and availability may be updated from time to time.
4. Kilt Measurements and Sizing
Customers are responsible for checking the applicable size and measurement information before ordering.
Kilt sizing may differ from ordinary trouser sizing. Customers should follow the measurement instructions shown on our website or product page.
For products made to measurements or specifications supplied by the customer, it is particularly important that the measurements provided are accurate.
If we manufacture an item incorrectly compared with the measurements or specifications accepted with the order, this does not affect your statutory rights.
5. Made-to-Measure and Personalised Products
Some products may be made to measurements or specifications selected or supplied by the customer.
Where a product is genuinely made to the customer's individual specifications or is clearly personalised, statutory change-of-mind cancellation rights may not apply.
Examples may include a kilt made to unique measurements, a non-standard specification requested specifically by the customer, personalised embroidery or an item specially altered to the customer's individual instructions.
Simply preparing or producing an item after an order has been placed does not automatically mean that it is a personalised or bespoke product.
Any restriction on cancellation or returns for a personalised or custom-made product does not affect your statutory rights where the product is faulty, damaged, not as described or does not conform to the agreed order.
Please check all measurements and customisation details carefully before placing your order.
6. Orders
When you submit an order through our website, you are offering to purchase the selected products.
After receiving your order, we may send an acknowledgement or confirmation email.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
-
A product is unavailable
-
There is an obvious pricing or description error
-
Payment cannot be authorised
-
We cannot deliver to the address provided
-
We reasonably suspect fraudulent or unauthorised activity
-
We are legally prohibited from supplying the product
If we cancel an order after taking payment and no amount is otherwise lawfully due, we will refund the relevant payment.
Please check your order, measurements, delivery address and other information carefully before submitting it.
7. Prices and Payment
Prices displayed on our website are shown in the currency selected or displayed by the store.
Applicable taxes will be displayed or handled as required.
Shipping charges are shown separately where applicable and will normally be displayed before you complete checkout.
International customers may also be responsible for customs duties, import taxes or local charges where these are not collected at checkout.
We accept the payment methods displayed during checkout.
We reserve the right to correct genuine pricing errors. If an obvious pricing error affects an order, we may contact you before fulfilling the order and give you the option to proceed at the correct price or cancel the affected order.
8. Promotions and Sale Products
We may offer sales, discount codes or other promotions from time to time.
Promotions may have additional terms, qualifying dates or eligibility requirements.
Sale and promotional items remain subject to applicable statutory consumer rights.
A reduced price does not remove a customer's legal rights where goods are faulty, not as described or where statutory cancellation rights otherwise apply.
9. Shipping and Delivery
Available shipping services, charges and estimated delivery times are described in our Shipping Policy and during checkout.
Delivery estimates are estimates unless we expressly agree to a guaranteed delivery date.
Some made-to-measure, customised, handmade or selected products may require production or preparation time before dispatch.
Selecting express shipping normally affects the carrier delivery service after dispatch. It does not automatically reduce any stated production or preparation time unless we specifically confirm otherwise.
We are not responsible for delays caused by circumstances outside our reasonable control, but nothing in these Terms removes any rights you may have under applicable consumer law.
For UK consumer orders, risk of loss or damage normally remains with us until the goods come into your physical possession, or the physical possession of a person identified by you to receive them.
Different rules may apply where you independently arrange a carrier that was not offered by us.
Please see our Shipping Policy for further information.
10. International Orders
We sell to selected countries and regions.
International orders may be subject to customs clearance, import duties, taxes and other charges imposed by the destination country.
Unless these charges are specifically collected during checkout, the customer may be responsible for paying them.
Customers are responsible for checking applicable import requirements in their destination country.
11. Cancellation and Returns
Your cancellation and return rights are explained in our Return & Refund Policy.
Where UK statutory distance-selling cancellation rights apply to an eligible product, you normally have 14 days after receiving the goods to notify us that you wish to cancel.
After notifying us, the goods must normally be returned within the applicable statutory period.
Different rules may apply to goods genuinely made to your specifications or clearly personalised.
Nothing in our Return & Refund Policy or these Terms removes your statutory rights in relation to faulty, damaged, incorrect or misdescribed goods.
12. Return Shipping and Delivery Charges
Where an eligible product is returned because the customer has changed their mind, the customer may be responsible for the direct cost of returning it where permitted by law and where they have been informed of that responsibility.
Where statutory cancellation rights require us to refund the original outbound delivery charge, we will refund the amount required by law.
If you selected a more expensive delivery service than our least expensive standard delivery option, we are not required to refund the additional cost of that upgraded service where applicable law permits.
Where goods are faulty, incorrect or otherwise do not conform to the contract, return costs will be handled in accordance with applicable consumer law.
13. Service and Handling Charges
We do not automatically deduct a 10% service or handling charge where a customer is exercising a statutory cancellation or refund right that requires the applicable payment to be refunded.
Where a statutory cancellation right does not apply, a reasonable service, handling or cancellation charge may apply only where permitted by law, clearly communicated and appropriate to the circumstances.
Nothing in this section limits your statutory consumer rights.
14. Condition of Returned Products
For eligible change-of-mind returns, customers may inspect products to establish their nature, characteristics and functioning in a manner similar to what would reasonably be permitted in a shop.
Where permitted by law, we may make an appropriate deduction from a refund if the value of the product has been reduced because it was handled beyond what was reasonably necessary.
Returned products should not be unnecessarily worn, washed, altered or damaged.
Please return original tags and packaging where reasonably possible.
15. Free Gifts and Promotional Items
Where a free promotional item was provided because an order met specified promotional conditions, the free item may need to be returned if the qualifying order is cancelled or returned.
If only part of an order is returned and the remaining order no longer meets the conditions of a promotion, any adjustment will be handled in accordance with the promotion terms and applicable law.
16. Faulty, Damaged or Incorrect Goods
Please contact us if you receive goods that are faulty, damaged, incorrect or not as described.
We may ask for your order number, photographs and other reasonable information to help us understand the issue.
We will provide an appropriate remedy in accordance with applicable consumer law.
Nothing in these Terms limits your statutory rights relating to faulty or misdescribed goods.
17. Product Availability
Products are subject to availability.
We may change or discontinue products and may limit quantities where reasonably necessary.
Adding an item to your shopping basket does not reserve that product.
If we cannot fulfil an accepted order, we will contact you and provide an appropriate refund for the unavailable item where required.
18. Intellectual Property
The Kilt District website and its original content, including our branding, logos, text, photographs, graphics, designs and other materials, are owned by or licensed to Kilt District unless otherwise stated.
These materials are protected by applicable intellectual property laws.
You may use our website for personal and non-commercial purposes.
You must not copy, reproduce, republish, distribute, commercially exploit or modify our protected content without permission, except where permitted by law.
Third-party trademarks and intellectual property remain the property of their respective owners.
19. Customer Reviews and Content
If you submit a review, photograph, comment or other content to Kilt District, you confirm that you have the right to submit it.
You must not submit unlawful, defamatory, misleading, abusive or infringing content.
Where you provide content for publication or promotional use, you grant us permission to use that content for the purposes reasonably connected with operating and promoting Kilt District, subject to applicable law and our Privacy Policy.
We may moderate or remove content where reasonably necessary.
20. Third-Party Links and Services
Our website may contain links to websites or services operated by third parties.
We are not responsible for the content, availability or practices of independent third-party websites.
Please review the applicable terms and privacy policies before using third-party services.
21. Relationship with Shopify
Kilt District is powered by Shopify, which provides the ecommerce technology that enables us to operate our online store.
Purchases made through Kilt District are transactions between the customer and Kilt District, not Shopify.
Shopify may process information relating to your use of our store as described in our Privacy Policy and Shopify's applicable privacy information.
Nothing in this section excludes any liability or consumer right that cannot legally be excluded.
22. Privacy
We process personal information in accordance with our Privacy Policy.
Because our online store is hosted by Shopify, certain personal information may also be processed by Shopify and other service providers that help us operate the website, process payments, fulfil orders and provide services.
Please review our Privacy Policy for further information.
23. Errors and Inaccuracies
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, availability or delivery information.
We may correct genuine errors and update information when necessary.
Nothing in this section permits us to remove or restrict statutory rights or make unfair changes to an existing consumer contract.
24. Prohibited Uses
You must not use our website:
-
For unlawful or fraudulent purposes
-
To infringe intellectual property rights
-
To transmit malicious software
-
To obtain unauthorised access to our systems
-
To collect personal information unlawfully
-
To impersonate another person
-
To interfere with the operation or security of our website
-
To engage in abusive, threatening or defamatory conduct
We may restrict access to the website where reasonably necessary to protect Kilt District, our customers or our systems.
25. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights concerning goods that are faulty, not as described or otherwise fail to conform to applicable consumer law.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or losses arising from circumstances outside our reasonable control.
If you purchase products primarily for business or commercial purposes rather than as a consumer, different legal rights and limitations may apply.
26. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control.
These may include severe weather, natural disasters, industrial disputes, transport disruption, customs delays, government action, war, civil disturbance, telecommunications failures or major carrier disruption.
Where such an event affects your order, we will take reasonable steps to minimise the impact and will comply with any rights you have under applicable law.
27. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
28. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
29. Changes to These Terms
We may update these Terms from time to time.
The version applicable to your purchase will generally be the version in effect when the relevant contract was entered into, unless a change is required by law or is otherwise validly agreed.
The current version will be available on our website.
30. Governing Law
These Terms and contracts between Kilt District and customers are governed by the laws of England and Wales.
If you are a consumer resident elsewhere, you may also benefit from mandatory consumer protections available under the laws applicable to you which cannot lawfully be excluded by these Terms.
Nothing in this section deprives a consumer of any mandatory rights regarding where proceedings may be brought.
31. Entire Agreement
These Terms, together with the policies and information incorporated into them, form the terms governing your use of our website and purchases from Kilt District.
If there is a conflict between these Terms and a mandatory requirement of applicable consumer law, the mandatory legal requirement will apply.
